- The Breast Basket is committed to providing quality products that are delivered to you in a safe and easy-to-use manner.
- In these Terms and Conditions, you will see that we articulate specific terms of sale to the extent permissible by law. Australian Consumer Law supersedes anything within these Terms and Conditions.
- Due to the sterile nature of each product, we are not able to offer a refund for change of mind, as the packaging needs to remain intact to ensure a safe and bacteria free environment.
- Placing an order
- You may order our Products through selecting and submitting your order through this website, in accordance with these Terms and Conditions.
- Colours of products are determined on stock. Products that have a potential colour change option are: hot and cold packs (pink and grey), bracelets (pink, multi colour and blue) and water bottles (multiple colour combinations). If any particular colour is preferred, please email at [email protected] to secure your colour preference. Please reference your order number in your email.
- Payment
- All prices on The Breast Basket’s Website are shown in Australian Dollars (AUD)
- The Website utilises Stripe as a payment gateway to ensure your payment is processed securely.
- Acceptance of Orders
- We reserve the right to decline any order received for any reason, including (without limitation) if the Product requested is unavailable.
- If your order is declined, you will receive written notice within three business days of the date your order was placed.
- Any order not declined under this clause is accepted by us.
- Packing of Orders
- The Breast Basket will ensure that each order is safely and securely packed for transportation, having regard to:
- The fragility and perishability of each product
- The distance the order is likely to travel; and
- The method of transportation used to transport the goods.

- Payment must be made in full prior to sending the Order. The delivery fee includes shipping and purchase of shipping materials.
- At the time of dispatch, a confirmation email will be sent to the purchaser.
- If any products are not available for any reason (including, but not limited to, supply issues) contact will be made to the purchaser to give up-to-date expectation of delivery time, or an option to replace/substitute a product may be offered. Alternatively, the purchaser may choose to cancel the order.
- The Breast Basket is not liable for any personal loss or damages incurred by a delayed shipment, or for accepting a product substitution.
- Cancellation of Order
- You may cancel your order by emailing The Breast Basket where we:
- Inform you that we have stock delays and require further time to fulfill your order;
- We are not able to deliver your Order within a reasonable time of the estimated delivery time advertised on the website. This does not include delays for which the purchaser is wholly or partially responsible, such as failure to provide delivery address or process full payment.
- If an Order is cancelled after payment has been processed, The Breast Basket will refund money paid. If only part of an Order is cancelled, The Breast Basket will process a refund for money paid in relation to the cancelled part of the Order.

- Your purchase of Goods will be subject to certain laws including, without limitation, the Australian Consumer Law.
- All Goods come with guarantees that cannot be excluded under the Australian Consumer Law.

- Safety
- Safety warnings are clear on the products and The Breast Basket’s website.Failure to follow instructions and usage guidelines for each product may result in injury or harm. Instructions and usage guidelines are available both on our website and upon purchase of each product.
- If you are advised to avoid a product by a medical practitioner, do not use the product.
- All products have been checked and assessed before delivery, but it is the responsibility of the purchaser to inspect each product prior to use. Alert The Breast Basket via email if any items are faulty (ie: gel leaking from a hot and cold pack) to request a replacement.
- Proper care needs to be taken to ensure the appropriate lifespan for re-usable products. The Breast Basket is not liable for replacing a damaged product caused by misuse or neglect.
- Thorough cleaning after each use of the Haakaa Pump is required. Failure to properly clean the product could potentially cause harm. The Breast Basket will not be liable for any harm/illness caused by failing to properly clean or care for the Haakaa Pump.
- Re-usable breast pads need to be cleaned daily to reduce the risk of bacteria growth or fungal infection. The Breast Basket is not liable for any harm caused by failing to properly clean breast pads.
- Heat and cold packs, have potential for suffering hot and cold burns.
- The Breast Basket does not take any responsibility for potential choking hazards, in particular bracelet and cap of Lanolin. Small objects can cause harm to children and animals, these items should be kept away to avoid any harm.
- The Breast Basket does not take any responsibility for any reaction to any products, particularly Lansinoh HPA Lanolin and Rite Aid Hydrogel Breast Discs.
- The Breast Basket does not guarantee a successful breastfeeding journey. The Breast Basket is a supplier of equipment and provides an information guide on basic breastfeeding information to help support successful breastfeeding. The products have been chosen by a qualified RM/RN/MCHN based on years of experience in the maternity field. The information in the booklet is to be used as a guide only, and is not intended to replace advice from your doctor or other healthcare professional. Please consult relevant healthcare providers for clarification and assistance with breastfeeding. The booklet has been reviewed and supported by an LC to further support information.

- Privacy
- When you place an Order through this Website, you consent to The Breast Basket collecting your personal information (including your name, contact details and delivery address) for the full purpose of fulfilling and delivering your order.
- All customer details (excluding credit card information) are stored securely, unless you request for us to delete this information.
- Returns and Refunds
- Unless we have received communications to the contrary by email or telephone within 7 days of delivery, the Products shall be deemed to have been accepted by you.
- The Breast Basket will accept product returns and provide refunds if the product delivered:
- Is deemed Faulty or not of merchantable quality;
- Is not fit for its intended purpose;
- Does not match the description on our Website; or
- Otherwise fails to meet any mandatory guarantees imposed by applicable laws.
- The Breast Basket requests that any concerns with products be raised within seven days of receiving parcels either by telephone or email.
- Photographic evidence of the faulty product will need to be provided.
- Refunds are not granted for damage caused by misuse or neglect on behalf of the purchaser.
- For health and hygienic reasons, we do not accept refunds resulting from a purchaser’s change of mind.
- Where The Breast Basket is obliged to refund your money in accordance with these Terms and Conditions, The Breast Basket intends to initiate your refund within two business days.
- Refunds will only be issued in Australian dollars.
- Rights in Relation to the Goods
- Ownership of the products contained in the order pass to you as the purchaser when you make payment.
- Risk passes with the property in accordance with the Goods Act 1958 (Vic).
- General Provisions
- We reserve the right to amend these Terms and Conditions at any time, however we cannot vary the terms and conditions which apply to a given order after that order is accepted by us.
- If the whole or any part of a provision of these Terms and Conditions is void, unenforceable or illegal it is severed and the remainder of these Terms and Conditions has full force and effect.
